Mental Health Act guidance

This page sets out guidance in managing the procedure for Section 117 of the Mental Health Act 1983.  
This document provides the legislative context and practice issues to be considered in care planning for people who have been subject to detention under the Mental Health Act 1983 Sections 3, 37,45A, 47 or 48. 

Section 117 responsibility lies with both the NHS and Social Care commissioners of services. 
The guidance aims to set out the requirements and processes for supporting people who have been discharged from hospital following detention under a Mental Health Act section, and in order to sustain their living in the community, including providing services which seek to avoid re-admission to hospital psychiatric care. 
The guidance includes recognition that not all social care or health needs are related to Section 117 aftercare requirements and provides information about when and how people can be discharged from Section 117.
