Highways development

Highway development comes under part 9 of the order. The order permits a highway authority to carry out:

  • necessary work to maintain or improve roads
  • necessary or incidental work outside but adjoining road boundaries

This allows highway authorities to maintain and improve existing road networks. Any new roads will need a planning application.

The order does not define ‘improvement’. But Part V of the Highways Act 1980 lists what comprises ‘improvement’ under the highway authority’s statutory powers to carry out this work.

Although the Highways Act does not refer to Part 9 of the Order, it could be considered that Part 9 is meant to enable those improvements. So any improvement work planned under those statutory powers could be viewed as being permitted under Class A: Part 9.
